Terms of service

• +You own your content. We host it, process it with AI, and show it back to you.
• +You are responsible for getting respondents to agree to record, and for making sure what you do with their answers follows the law.
• +Subscriptions renew automatically. You can cancel in your account at any time.
• +Our liability is capped at the fees you paid in the last twelve months.
• +Swiss law governs this agreement. Disputes go to the courts of the Canton of Zürich.

Talkful is operated by Metascend GmbH, a Swiss company registered in the Canton of Zürich (UID CHE-195.997.652). In these terms, "we", "us", and "Talkful" mean Metascend GmbH."You" means the person or organization that signs up for an account.

By creating an account or using the service, you accept these terms. If you are using Talkful on behalf of an employer or client, you confirm that you have the authority to bind them.

Talkful is an AI-powered asynchronous user research tool for product teams. You create questions, share a link, and participants answer in voice, text, choice, or rating. An AI interviewer asks smart follow-ups in real time, and the service returns transcripts, translations, themes, sentiment, and quotes produced by AI. Feature set, pricing, and limits can change. Breaking changes to paid features are announced at least 30 days in advance.

• +You must be at least 18 years old to hold an account.
• +You are responsible for keeping your credentials confidential and for everything that happens under your account.
• +Notify us at hello@talkful.io if you suspect unauthorized access.

You are the controller of the personal data you collect through Talkful. That means you are responsible for:

• +Getting respondents to agree before they record (we show a consent screen by default).
• +Telling respondents what you will do with their recordings.
• +Making sure respondents are at least 16 years old, and following any stricter age rule that applies to your audience.
• +Responding to respondent requests to access, correct, or delete their data.

We act as your processor for respondent data. Our processor obligations are set out in our privacy policy and, for Pro customers, in a separate Data Processing Agreement available on request.

You agree not to:

• +Use Talkful to collect recordings without consent, or to coerce or deceive respondents.
• +Upload content that is unlawful, infringing, or that promotes violence, hate, or illegal activity.
• +Reverse engineer the service, scrape it, or try to access other accounts.
• +Circumvent rate limits, resell API access, or run automated traffic that degrades the service for others.
• +Use Talkful to build a competing product, or use its outputs to train another AI model.

We can suspend or terminate accounts that violate this section. Where the breach is serious we may do so without notice.

You own the questions you write, the studies you create, and the responses submitted to your studies. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, transcribe, translate, and analyze that content solely to provide the service to you.

We do not use your content to train AI models, and our AI subprocessors are contracted on terms that prohibit using your content for their own training. Aggregate, de-identified metrics (total studies, uptime, latency) may be used to operate and improve the service.

Transcripts, translations, themes, and quotes are produced by large language models. They are best-effort and can be wrong. You are responsible for reviewing outputs before acting on them, and for not using them as the sole basis for decisions that have legal or similarly significant effects on people (hiring, lending, housing, healthcare).

• +Free. Up to ten participants per month, unlimited studies, unlimited users. Includes the full AI synthesis pipeline and a "Powered by Talkful" footer on the participant page.
• +Starter. $39 per month (or $348 per year, equivalent to $29 per month). Up to 100 participants per month across your workspace, unlimited studies, unlimited users, ask AI anything about your study, CSV and JSON export, email support.
• +Pro. $99 per month (or $948 per year, equivalent to $79 per month). Up to 1,000 participants per month across your workspace, unlimited studies, unlimited users, Slack and Linear and Jira integrations, branding removed, priority email support.
• +Upgrades. You can upgrade between plans at any time. The new plan begins immediately and your card is charged for the first billing period.
• +Billing cycles. Subscriptions renew at the start of each billing period until you cancel. Annual plans are charged up front and are non-refundable.
• +Price changes. We can adjust pricing for future billing periods with at least 30 days of notice by email.
• +Taxes. Prices are exclusive of VAT and other applicable taxes, which are added at checkout where required.

Billing is handled by Stripe. Managing your plan (upgrading, downgrading, updating payment method, cancelling) is done through the Stripe Customer Portal from your account settings.

We do not offer refunds for partial months or unused portions of annual plans. You can cancel at any time and keep access until the end of the current billing period.

You can close your account at any time from settings. We can suspend or terminate your account if you materially breach these terms, if required by law, or if we discontinue the service. On termination we delete your data within 90 days, except where longer retention is legally required (see the privacy policy).

We aim for high availability but do not guarantee uninterrupted service. Maintenance windows, third-party outages, and incidents happen. Pro customers get priority email support at hello@talkful.io with a one business day response target. Free accounts get best-effort support.

To the maximum extent permitted by law, Talkful is provided on an "as is" and "as available"basis. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing.

To the maximum extent permitted by law, neither party is liable for indirect, consequential, special, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability under these terms is capped at the fees you paid to us in the twelve months before the event that gave rise to the claim. These limits do not apply to liability that cannot be limited under Swiss law (including gross negligence and willful misconduct).

You will defend and indemnify us against claims brought by a respondent or third party arising out of your content, your studies, or your breach of these terms, including where you collected data without adequate consent.

Each party will protect the other's confidential information with the same care it uses for its own (no less than reasonable care) and use it only to perform this agreement. This does not apply to information that becomes public through no fault of the receiving party, or that the receiving party already had, or must disclose under law.

We can update these terms. When changes are material we will email account holders at least 30 days before they take effect. Continuing to use the service after the effective date means you accept the new terms. If you do not accept them you can cancel your subscription before the effective date.

These terms are governed by Swiss substantive law, excluding its conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes is the ordinary courts of the Canton of Zürich, Switzerland, subject to mandatory consumer protection law where applicable.

• +If a provision is found unenforceable, the rest of the terms stay in effect.
• +Our failure to enforce a provision is not a waiver of the right to do so later.
• +You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• +These terms are the entire agreement between you and us about the service.
